Agreement between User and Big Hit Creative Group

Welcome to promotionalitems.bighitcreative.com (the “Site”), owned and operated by Big Hit Creative Group (“Company,” “we,” “us,” or “our”). These Terms & Conditions (the “Terms”) govern your access to and use of our Site and related services for purchasing promotional products. By accessing or using our Site, you agree to be bound by these Terms, our Privacy Policy, and our Return & Refund Policy.

1. Privacy

Your use of our Site is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

2. Changes to Terms

We may update these Terms at any time without prior notice. Any new features, tools, or resources added to the current Service will also be subject to these Terms. Your continued use of the Site after changes are posted constitutes your acceptance of those changes.

3. Overage/Underage and Return Policy

  • Final Sale on Custom Products: After proof approval, all sales are final. No refunds or returns are allowed for customized products.
  • Overage/Underage Allowance: Industry standard allows for up to 5% over or under the ordered quantity. We reserve the right to ship and bill, or credit, your account accordingly.
  • Setup Fees: There are no refunds for setup fees.
  • Inspection Period: You must inspect your order upon receipt. If you have any issues, contact our customer service team within 7 days at 972-850-7312 or info@bighitcreative.com. After this time, we cannot work with suppliers on adjustments.

4. Account Terms

  • You must be at least 18 years old to use this Site.
  • Accounts must be registered by a human. Accounts created by automated methods (“bots”) are not permitted.
  • You must provide your legal name, valid email address, and any other information requested to complete the signup process.
  • You are responsible for maintaining the security of your account and password, and for all activity under your account.
  • You may not use the Service for illegal or unauthorized purposes, including violations of copyright law.

5. Acceptable Use

You agree not to:

  • Use the Site in any way that violates applicable laws.
  • Upload or transmit any harmful code, viruses, or malware.
  • Post or transmit defamatory, obscene, or infringing content.
  • Interfere with the functionality of the Site or other users’ access.

6. Third-Party Services

We do not use customer-provided artwork, order details, or project information to train AI models without your explicit written consent. We may use AI-assisted tools internally to improve production workflow, subject to confidentiality and data protection measures.

9. Indemnification

You agree to indemnify and hold harmless Big Hit Creative Group, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including attorneys’ fees) arising from your violation of these Terms or your misuse of the Site.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages (including lost profits) arising from your use of the Site or products purchased.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration in Dallas County, Texas, under the rules of the American Arbitration Association. Class actions are not permitted.
